Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to provide adequate police protection to petitioner for putting up fencing around petitioner's land situated in Survey No.452/2C2, measuring 3 cents, Nuthulapuram Village, Nilakottai Taluk, Dindigul District, pursuant to the survey conducted and the order passed by this Court based on the petitioner's representation dated 11.10.2024.

ORDER

This Writ Petition is filed for Mandamus to direct the respondent to consider the petitioner's representation dated 11.10.2024 and provide adequate police protection to the petitioner for putting up fencing around his land in Survey No.452/2C2 measuring 3 cents, Nuthulapuram Village, Nilakottai Taluk, Dindigul District.

2. It is the case of the petitioner that survey was conducted on the petitioner's land and the boundaries were marked; that however, a third person is interfering with the fencing of the property; and that there is threat to the petitioner's possession.

3. The person, who is alleged to have prevented the petitioner from fencing the property, is not made a party in this Writ Petition. The respondent cannot interfere in such disputes. If the petitioner is aggrieved by action of any third party, it is open to him to approach the Civil Court. However, if the petitioner's complaint discloses any cognizable offence, the respondent Police may take appropriate action in accordance with law. 2/4

4. With the above observations, this Writ Petition stands disposed of. There shall be no order as to costs.
