ORDER

This Writ Petition is filed seeking to issue Writ of Mandamus directing the Respondents 1 and 2 to consider my representation dated 11.02.2025 and provide adequate police protection to the volley Ball playground situated at Puthukudieruppu Oor, Nagercoil, Kanyakumari District, thereby enabling the villagers, Oor members and other members of the Perunthalaivar Kamarajar Volleyball Club (Regn. No.SRG/KK/1/2021) to play and conduct sports and welfare activities peacefully.

The learned counsel for the petitioner submitted that the respondents 3 to 6 are continuously preventing the petitioner's society members and villagers from peacefully playing Volleyball in the aforesaid ground. Hence he had submitted a representation on 11.02.2025 requiring the respondent police to offer necessary police protection to conduct volleyball tournaments during Pongal festival and also summer vacation. The same is not considered and hence this Writ Petition is filed.

3. The learned Government Advocate on instruction submitted that the representation was only with respect to theft of Volleyball Net by certain miscreants. An enquiry was conducted and a first information report in Crime No.111 of 2025 was registered. Thereafter, on return of the stolen Volleyball Net by the miscreants, the said first information report was closed as action dropped.

4. Per contra the learned counsel for the petitioner submitted that the present representation was submitted after the closure of the earlier complaint regarding the theft of Volleyball Net. 3/6

5. Heard either sides and carefully perused the materials available on record.

6. Since no adverse order is proposed to be passed as against respondents 3 to 6, notice to them is dispensed with.

7. This Court is of the considered view that the spirit of sports among the villagers should be nurtured and secured by the respondent police. In view of the same, the respondent police is directed to consider the petitioner's representation dated 11.02.2025 and further issue summons on the petitioner as well as the respondents 3 to 6 under Section 64 BNSS and conducted discrete enquiry, making it clear to the respondents 3 to 6 that they should not create any disturbance in the peaceful conduct of Volleyball tournaments in the playground in future. It is also made clear that the petitioner will be at liberty to make proper representations from time to time to the second respondent police, whenever tournaments are conducted, for necessary police protection and on receipt of the same, the second respondent police is directed to provide necessary police protection on the date of tournaments. 4/6
