By asserting that the title to the property in survey No.574/56 was through inheritance and by relying on patta No.2842, the petitioner had applied for a survey of the property. The present Writ Petition relates thereto.
2. Learned counsel for the petitioner submits that the fourth and fifth respondents were tenants in the property earlier and have vacated from the said property. He also submits that they filed civil suits seeking declaration and injunction. By an order dated 01.07.2025 in C.R.P.(MD) No.907 of 2025, he points out that this Court directed that the suits be struck off on the ground of res judicata. He, however, submits that the said persons have been joined as respondents so as to enable issuance of notice to them by the revenue officials in relation to the survey. 2/5
3. Learned Special Government Pleader accepts notice on behalf of respondents 1 and 2 and learned Government Advocate (Crl.Side) accepts notice for the third respondent. The patta stands in the name of the petitioner and her late mother. The death certificate of the mother has been filed and a copy of the judgment and decree in an earlier suit in O.S.No.197 of 2000 has also been filed. Therefore, a case is made out to consider the petitioner's application.
4. Accordingly, the first and second respondents are directed to initiate action on the petitioner's application for a survey after issuing notice to owners of relevant adjacent lands and the fourth and fifth respondents herein. Objections, if any, from the said persons shall be taken into account before a decision is taken. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. No costs.
