ORDER

This contempt petition has been filed on the basis that the direction given by us on 21.08.2025 in W.P.(MD)No.22598 of 2025 has not been complied with.

2.In fact, we had not given any specific direction as such. We only recorded the stand of the respondents that all the encroachments would be removed within four weeks with effect from 21.08.2025. 3.Subsequently, the alleged encroachers filed W.P.(MD)No.33351 of 2025. We had given breathing time to the encroachers. Since right to file an appeal under Section 10 of the Land Encroachment Act is a 2/6

statutory right, we directed that the eviction action shall be put on hold till the appeal is disposed of.

4.In these circumstances, the respondents cannot be said to have committed any contempt. Therefore, we close this contempt petition. We give liberty to the petitioner to file a sub application and revive the contempt petition, if even after disposal of the appeal against the encroachers consequential action is not taken.
