5. P.Rathinavelu .. Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the second respondent to dispose the case in Na.Ka.No.4402/2011/A2, which is pending before the second respondent.

ORDER

This writ petition is filed seeking a writ of Mandamus to direct the second respondent to dispose of the case in Na.Ka.No. 4402/2011/A2, which is pending on his file.

2.Heard both sides.

3.The case of the petitioner is that he filed a petition before the second respondent, seeking to cancel the joint patta issued in respect of his property, comprised in Survey No.12/14, A.Kokkukulam, Thirumangalam Taluk, Madurai District and the same is pending in Na.Ka.No.4402/2011/A2, for a long time. Therefore, the petitioner is before this Court.

4.The learned counsel for the petitioner would submit that it would be suffice, if the said proceedings is directed to be disposed of by the second respondent, as per law. 5.Considering the limited scope of the relief sought for, this Court, without going into the merits of the petitioner's claim, directs the second respondent to dispose of the proceedings in Na.Ka.No.4402/2011/A2 on its own merit and in accordance with law, after affording due opportunity of hearing to the petitioner as well as all the interested parties, including the fifth respondent, within a period of eight weeks from the date of receipt of a copy of this order.
