ORDER

Heard the learned counsel for the writ petitioner and the learned Government Advocate for the respondents 1 to 4. Issuance of notice to the respondents 5 to 8 is dispensed with.

2.The petitioner alleges that the private respondents herein have committed encroachment on a public pathway (petition mentioned cart track). He wants the same to be cleared.

3.When the matter was taken up for hearing, the learned Government Advocate submitted that the propose has already been initiated. Survey is proposed to be held shortly. Notices shall be issued to all the interested persons including the private respondents herein. If the results of the survey indicate that there are encroachments, then by adhering to due process of law, the same shall be removed. The entire exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. I stress that the principles of natural justice will have to be scrupulously complied with. It means that any person who is alleged to be an encroacher or against whom action is proposed to be taken, has to be put on notice before any final order is passed or enforced.
