By relying on a settlement deed dated 04.08.2021 and patta No. 1551, the petitioner had applied for a survey of land in survey Nos. 582/3B and 589/1B. The present Writ Petition relates thereto.
2. Learned Special Government Pleader accepts notice for respondents 1 and 2 and learned Government Advocate (Crl.Side) accepts notice for the third respondent. On perusal of the settlement deed and the patta, it appears that the total extent in the two survey numbers mentioned above was settled in favour of the petitioner. The patta, however, is a joint patta in the names of the petitioner and one Kanagaraj. 2/5
Learned counsel for the petitioner submits that the said Kanagaraj is cousin and that there is no dispute between the pattadars. Nonetheless, notice should be issued to the said Kanagaraj and objections, if any, from him should be considered.

Accordingly, this Writ Petition is disposed of by directing the first and second respondents to initiate action on the petitioner's request for a survey after issuing notice to Kanagaraj, respondents 4 to 6 and any other relevant adjacent land owners. Objections, if any, from the said persons shall be taken into account before a decision is taken. For avoidance of doubt, it is clarified that if there is any credible title dispute, the survey should not be conducted. On the other hand, boundary disputes may be decided by the first and second respondents. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. No costs.
