O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the first respondent to conduct survey in SF.No. 73/1A2 for an extent of 1375 Sq.ft (800 sq.ft and 575 Sq.ft) in Oonjampatti Village of Theni Taluk, Theni District, by considering the petitioner's representation dated 30.10.2025.

2. Heard the learned counsel for the parties and perused the materials available on record.

3.The learned counsel appearing for the petitioner submits that a representation dated 30.10.2025 was made seeking a survey of the subject property. Since no action has been taken by the respondents, the present writ petition has been filed.

4. The learned Government Advocate appearing for the first respondent submits that if the petitioner annexes the patta of the subject land in his name, appropriate steps will be taken on the petitioner's application after considering the claims of all parties and conducting an 2/5

inquiry, in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. In view of the above, this Court directs the petitioner to furnish the patta of the subject land to the first respondent. Upon receipt of the same, the first respondent shall consider and dispose of the petitioner's representation dated 30.10.2025, on its merits and in accordance with the law. Notice shall be issued to the petitioner, the second respondent and the owners of relevant adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of twelve weeks from the date of receipt of a copy of this order.
