A notice issued by the second respondent in relation to the request for a survey made by the third respondent is challenged in this Writ Petition. Learned counsel for the petitioner submits that a joint patta was issued in the name of the petitioner, his brothers and one Gangadharan. He also submits that the survey cannot be carried out unless a partition is effected.

2. Learned Government Advocate accepts notice for respondents 1 and 2. He submits that the petitioner's objections would be considered in course of inquiry and a speaking order would be issued.

3. In view of the above submissions of learned Government Advocate, the apprehensions of the petitioner have been allayed. Therefore, by directing the first and second respondents to conduct an 2/4

inquiry in relation to the third respondent's request for a survey and consider the objections of the petitioner, this Writ Petition is disposed of. For the avoidance of doubt, it is clarified that a speaking order should be issued upon conclusion of the inquiry. No costs. Consequently, connected miscellaneous petition is closed.
