Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus directing the 1st respondent to remove the vehicle bearing Vehicle No.TN 63 BX 4525 from the block list or to provide No objection certificate and to receive Motor Vehicle Tax by the 2nd respondent based on petitioner's representations dated 14.10.2025 and 13.10.2025.

ORDER

This Writ Petition has been filed to direct the first respondent to remove the vehicle bearing Registration No.TN 63 BX 4525 from the block list or to provide No Objection Certificate and to direct the second respondent to receive Motor Vehicle Tax, based on the petitioner's representations dated 14.10.2025 and 13.10.2025.

2. The learned counsel appearing for the petitioner would submit that the petitioner has purchased the vehicle through auction conducted by the Finance Company and at present, the vehicle is under the block list. Therefore, the petitioner is not in a position to pay the tax.

Per contra, the learned Special Government Pleader appearing for the respondents would submit that the learned Principal District and Sessions Judge, Sivagangai by virtue of order dated 22.08.2024 block listed the vehicle bearing Registration No.TN 63 BX 4525, wherein, it was ordered not to renew the Registration Certificate Book and not to transfer the ownership of the said vehicle. However, in violation of the said order, the vehicle was transferred. Therefore, he prayed for dismissal of this petition. 2/5

4. I have given due consideration to the submissions made on either sides.

It appears that the learned Principal District and Sessions Judge, Sivagangai, passed an order not to renew the Registration Certificate Book and not to transfer the ownership of the vehicle bearing Registration No.TN 63 BX 4525. The above order is not the person centric, but the vehicle centric. The said order would apply not only to the owner, but also to the Finance Company and subsequent purchaser. Therefore, the petitioner cannot take a stand that the order of the learned Principal District and Sessions Judge, Sivagangai would apply only to the owner of the vehicle and not to the Insurance Company.

In the present case, apparently, the petitioner has purchased the vehicle bearing Registration No.TN 63 BX 4525, in contrary to the order passed by the learned Principal District and Sessions Judge, Sivagangai, dated 28.08.2025. Such being the case, this Court does not find it appropriate to remove the block list by virtue of this Writ Petition. There is no force in the submissions of the petitioner and this Writ Petition is devoid of merits.
