ORDER

The petitioner seek to quash the impugned charge sheet in C.C.No.1065 of 2024 on the file of the learned Judicial Magistrate No.5, Additional Mahila Court, Tirunelveli District, which was filed for the offences under Sections 294(b) and 352 of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act.

2.When this Court expressed that the points raised by the learned counsel for the petitioner are factual in nature, the learned counsel for the petitioner sought permission of this Court to withdraw this petition and has made an endorsement to that effect. However, the learned counsel for the petitioner would request that the personal appearance of the petitioner before the trial Court may be dispensed with.

3. In view of the above submission, this Criminal Original Petition is dismissed as withdrawn. However, considering the request of the petitioner, the personal appearance of the petitioner before the Trial Court is dispensed with on all hearing dates (provided he is represented 2/4

by a lawyer) unless his appearance is required by the learned Magistrate for the progress of the trial. Consequently, connected miscellaneous petitions are closed.
