Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents to conduct a proper resurvey of the lands of the petitioner in Survey Nos. 78/1A3, 78/15B, 78/4 and 78/5, situated at Vavidamaruthur, Hamlet of Mettupatti Village, Vadipatti Taluk, Madurai District in accordance with the petitioner's registered settlement deed dated 04/10/2021 bearing Document No. 4583 of 2021 on the file of the Sub Registrar, Alanganallur and sale deed dated 07/09/2022 bearing Document No. 5312 of 2022 on the file of the Sub Registrar, Alanganallur and as per the Field Measurement Book sketch, by 1/4
including the full extent of the properties particularly the slanting portions of survey Nos.78/4 and 78/5 which were omitted by the fourth respondent.

By tracing title from the antecedent document, the petitioner relies on a gift settlement deed dated 04.10.2021 and a sale deed dated 07.09.2022 as also patta Nos.4738, 4469, and 4517 as evidence of the petitioner's title and rights in relation to survey Nos.78/15B, 78/4, 78/5 and 78/1A3B. An application for conducting a survey of the above mentioned lands was filed by the petitioner. In response thereto, it is stated that the Tahsildar and the Surveyor endeavoured to survey the property but did not carry out the survey or conclude the same.
2. Learned Additional Government Pleader accepts notice for all the respondents. He confirms, on instructions, that the survey was not concluded.

3. The petitioner has placed on record multiple title documents and the pattas in his name. Consequently, the petitioner has made out a case for consideration of his request. In the facts and circumstances outlined above, the third and fourth respondents are directed to initiate action to carry out and complete the survey relating to survey Nos.78/15B, 78/4, 78/5 and 78/1A3B after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. No costs.
