Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents 1 to 4 to conduct a proper inspection of the land comprised in S.No.1519/4, situated at Senthamangalam Melpagam Village, Avarakuruchi Taluk, Karur District and to ascertain whether the said land has been used as a burial ground. If, upon such inspection, evidence of burial is found, the respondents 1 to 4 may be further directed to forthwith classify and register the said land as burial ground in accordance with law.

O R D E R

[Order of the Court was made by DR.G.JAYACHANDRAN, J.] This Public Interest Litigation is filed with a purposive prayer to direct the respondents 1 to 4 to excavate the land in Survey No.1519/4 at Senthamangalam Melpagam Village, Avarakuruchi Taluk, Karur District, to ascertain that the said land was used as a burial ground earlier and if so, to classify the said land as a burial ground.

2. On the face of the prayer, it is very clear that the petitioners with some ill-motive have come to this Court and filed the present Public Interest Litigation. We are not inclined to entertain this Public Interest Litigation and to dismiss the same with costs.

3. Accordingly, this writ petition is dismissed with costs of Rs.5,000/- (Rupees five thousand only) payable by the petitioners to the Tamil Nadu State Legal Services Authority within a period of four weeks from the date of receipt of a copy of this order.
