ORDER

The petitioner seeks a direction to the respondents 1 and 2 to defreeze the petitioner's bank account, which was frozen by the first respondent during the course of the investigation in Crime No.24 of 2019.

2.The learned counsel for the petitioner would submit that the FIR was registered pursuant to a monetary dispute between the petitioner and the defacto complainant/third respondent and that the parties have arrived at a compromise, by which the petitioner has agreed to pay a sum of Rs.12,93,500/- the third respondent herein. The learned counsel would further submit that the amount of Rs.12,93,500/- is lying in the bank account of the petitioner; that the account may be defrozen for the purpose of settling the amount to the third respondent; and that there are 2/5

no other cases against the petitioner.

3.The learned Additional Public prosecutor appearing for the respondent police, on instructions, would submit that the entire account was not frozen and only the amount of Rs.12,93,500/- was frozen as per the instructions of the first respondent.

4.The learned counsel for the third respondent would submit that since the parties have arrived at a compromise, the amount which is lying to the credit of the petitioner's account may be directed to be returned and in fact, the parties have also entered into a memorandum of understanding.

5.In view of the above, the second respondent, is directed to lift the lien on the said amount of Rs.12,93,500/- and to credit the said amount to the account of the third respondent. The petitioner shall forthwith furnish the account details of the third respondent to the second respondent.

6.With the above observations, this criminal original petition is 3/5

disposed of.
