O R D E R

By relying on a sale deed dated 25.05.1992 and patta Nos.1243 and 1339, the petitioner had applied online for a survey of lands in survey Nos.607/1D2, 636/1A and 636/1B. The present Writ Petition relates thereto.

2. Learned counsel for the petitioner confirms that there is no rival title claim and that the third respondent is the owner of adjacent land.

3. Learned Government Advocate accepts notice for respondents 1 and 2. He submits that a notice would be issued to the third respondent and any other relevant owners of adjacent lands and that their objections would be considered before a decision is taken.

4. The petitioner has placed on record both title and revenue records relating to the relevant lands. Therefore, the petitioner is entitled to the consideration of the application for a survey. 2/4

5. Accordingly, this Writ Petition is disposed of by directing the first and second respondents to initiate action on the petitioner's request for a survey after issuing notice to the third respondent and to owners of any other relevant adjacent lands. Objections, if any, from the said persons shall be taken into consideration before a decision is taken.

6. For avoidance of doubt, it is clarified that boundary disputes may be decided by the official respondents, but the survey should not be conducted if there is a credible title dispute. The entire process shall be concluded within two (2) months from the date of receipt of a copy of this order. No costs.
