..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records of the second respondent pertaining to the rejection of the petitioner's legal heir certificate application number TN-720250116306 dated 16.01.2025 and consequently, direct the second respondent to issue legal heir certificate of the petitioner's late husband in the names of the petitioner and their daughter. ORDER

This writ petition has been filed to quash the impugned order passed by the second respondent rejecting the petitioner's legal heir certificate application number TN-720250116306 dated 16.01.2025 and consequential direction to the second respondent to issue legal heir certificate of the petitioner's late husband in the names of the petitioner and their daughter..

2. Heard the learned counsel appearing for the petitioner and Mrs.S.Jeya Priya, learned Government Advocate, who takes notice on behalf of the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. It is the case of the petitioner that her marriage was solemnized with Joseph Selvan Fidelis and they had a daughter Aura J.Athena in the year 2011. On 01.03.2024, due to cardiac arrest, the petitioner's husband died. Thereafter, she applied for legal heirship certificate through e-service. On 11.02.2025, the petitioner received an intimation via SMS that her application was rejected on the ground that 'the divorce decree of the parents of the deceased not attached', which according to the petitioner is irrelevant. It is her contention that her 2/4

father-in-law had deserted his wife and children long ago and presently out of contact. Hence, she did not possess his Aadhar details.

In this view of the matter, the impugned rejection made by the second respondent in the petitioner's Application No.TN-720250116306 dated 16.01.2025 is hereby set aside and the respondents are directed to reconsider the application of the petitioner and issue legal heirship certificate within a period of three weeks from the date of receipt of a copy of this order. If any party is aggrieved by the issue of the aforesaid legal heirship certificate, it is well open to them to challenge it.

5. Accordingly, this Writ Petition is allowed. No costs. Consequently, connected Miscellaneous Petition is closed.
