ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 9(m), 9(n), r/w Section 10 of Protection of Children from Sexual Offences Act in Crime No.62 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The prosecution is that the de-facto complainant is the mother of the victim girl and the victim girl and the victim girl is aged about 4 years. The petitioner and the de-facto complainant are relatives and neighbors as well and the daughter of the de-facto complainant used to play in the street with other children. Likewise, on 26.10.2025 at about 11.00 a.m., the daughter of the defacto complainant entered the house by crying and slept. Thereafter, on the same day in the evening, when the de-facto complainant and her daughter returned from the shop, the victim girl got scared on seeing the petitioner. On enquiring her, the de-facto complainant came to know that the petitioner took the victim girl to his house and touched her private parts. Hence, a case has been registered against the petitioner.
3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any 2/5
offence. He seeks this Court to grant anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) strongly opposed to grant anticipatory bail to the petitioner. 5.After perusing the 164 statement, this Court is not inclined to grant anticipatory bail to the petitioner. It is shocking to know that the victim who is only four years old could not express it. But she was terrified on seeing the aggressor / accused due to which the mother of the victim has discovered the same and preferred a complaint.
6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
7. Accordingly, this Criminal Original Petition is dismissed. 15.12.2025 TMG 3/5
