ORDER
The petitioners sought for quashing of the FIR registered for the alleged offences under Sections 296(b), 109 and 351(3) BNS (Corresponding to Sections 294(b), 307 and 506(ii) I.P.C.)

The gist of the allegation is that on account of prior enmity, the petitioners abused the defacto complainant in filthy language, threatened with dire consequences and when the petitioners attempted to attack the defacto complainant with knife, the defacto complainant ducked and thus, committed the aforesaid offences.

The learned counsel for the petitioners would submit that the allegations are false; that in any case, the defacto complainant has not sustained any injury; that the petitioners and the second respondent belong to the same village and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 28.10.2025.

4. The petitioners and the second respondent are present before this Court in person. They are identified by Mr.Chithambara Moorthy, Sub Inspector of Police, Nazareth Police Station Thoothukudi District. All the parties confirmed the compromise arrived at between them.
5. Though the petitioners are accused under Section 109 BNS (307I.P.C.), admittedly, no injury was caused to the defacto complainant. Hence, the offence under Section 109 BNS (307I.P.C.) is not be made out, in the facts of the case.
6. Considering the nature of the allegation and the relationship between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned FIR pending investigation. Accordingly, the impugned FIR is quashed and the Criminal Original Petition stands allowed. The joint compromise memo dated 28.10.2025, shall form part and parcel of the order. The petitioners shall jointly pay a cost of Rs.10,000/- (Rupees Ten Thousand only) to the Chief Minister's 3/5
Relief Fund and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
