1. State of Tamilnadu Rep by Inspector of Police, Natchiyarkoil Police Station, Thanjavur District, Crime No.393/2022.
2. Vigneshwaran, ... Respondents PRAYER :- This Petition is filed under section 528 BNSS, to call for the records in S.C.No.376 of 2025 on the file of the learned Additional District Judge(FTC), Kumbakonam, Thanjavur District and quash the charge sheet.

For Petitioners : Mr.Duraipandi.K, For Respondents : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor for R1 : Mr.K.Vijayan for R2
ORDER
The petitioners seek to quash the impugned final report in S.C.No. 376 of 2025 filed for the offences under Sections 147, 148, 294(b), 363, 324, 342 and 307 I.P.C.
2. The gist of the allegation is that on account of prior enmity, the petitioners had attacked the defacto complainant with hands and sticks, abused him in filthy language and thus committed the aforesaid offences.
3. The learned counsel for the petitioners would submit that though the petitioners are the accused under Section 307 I.P.C., the Doctor, who treated the defacto complainant, had opined that the injuries sustained by the defacto complainant is simple.

4. Admittedly, the petitioners and the second respondent belong to same village and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 20.11.2025.
5. The petitioners and the defacto complainant are present before this Court in person. They are identified by Mr.K.Ashok Kumar, Sub Inspector of Police, Natchiyarkoil Police Station, Thanjavur District. All the parties confirmed the compromise arrived at between them.
6. Though the petitioners are accused under Section 307 I.P.C, it is seen from the final report that the injury sustained by the victim is simple in nature and therefore, it cannot be inferred that the petitioners had committed the offence punishable under Section 307. I.P.C.
7. Considering the nature of the allegation, and the compromise arrived at between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report in S.C.No.376 of 2025 is 3/5
quashed and the Criminal Original Petition stands allowed. The joint compromise memo dated 20.11.2025, shall form part and parcel of the order. The petitioners shall jointly pay a cost of Rs.10,000/- to the Chief Minister's Relief Fund and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
