Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the Respondents to survey the land comprised in Survey Nos.30/1A and 30/2A Periyakottai Village, Oddanchathiram Taluk, Dindigul District based on petitioner's online application bearing No.2024/0123/13/003873 dated 09.07.2024 within a time frame as may be stipulated by this Court.

ORDER

By relying on settlement deed dated 04.03.1969 and patta No.2037, the petitioner had applied for the survey of land in S.Nos.30/1A and 30/2A.

2. Learned Government Advocate accepts notice for both the respondents. He submits that the respondents would initiate action on the petitioner's request for survey after considering objections, if any, of owners of relevant adjacent lands.

3. Patta No.2037 stands in the names of the petitioner and his brothers Murugesh and Subramani. Therefore, notice should be issued to the joint pattadhar. Notice should also be issued to owners of relevant adjacent lands. Objections, if any, from the said persons shall be considered before a decision is taken.

4. Subject to the above observations, this writ petition is disposed of by directing the respondents to initiate action on the petitioner's request for survey. The entire process shall be completed within three months from the date of receipt of a copy of this order. No costs.
