ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 296(b), 115(2), 118(1), 351(3) and 103 of BNS, 2023 @ Sections 191(2), 296(b), 103(1) and 351(3) of BNS, 2023, in Crime No.127 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that, on 20.06.2025, due to previous enmity, when the defacto complainant and the deceased were consuming liquor, the accused persons came to the spot, quarrelled with them, abused them in filthy language, attacked them with an iron rod, and threatened them. The deceased later succumbed to injuries while undergoing treatment at the hospital. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that the offences committed by the accused persons are serious in nature. Therefore, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the nature of offence, the specific overt act against the petitioner and also considering there are no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. (S S Y J) 26.11.2025 jbr To
