ORDER

An order dated 01.11.2025 rejecting the petitioner's request for patta is challenged on the ground that the said order is non-speaking.

Learned counsel for the petitioner refers to order dated 13.10.2025 in W.P.(MD)No.17624 of 2023 directing the Tahsildar to consider the petitioner's request for patta and dispose of the same by a speaking order. Learned counsel submits that the impugned order has been issued contrary to the said direction.

3. Learned Special Government Pleader accepts notice for all the respondents. On the basis of instructions, he points out that the current pattadhars are Amudhayammal, Arumugam and Kandasamy. After issuing notice to them, he submits that the matter would be reconsidered and that a speaking order would be issued.

4. On perusal of the impugned order, it appears that four separate and incompatible reasons are mentioned, without particulars, in respect of the 2/4

petitioner's request for patta in respect of S.No.279/6. Therefore, the order does not satisfy the requirements of a speaking order and is, consequently, set aside. In view thereof, the matter is remanded for reconsideration by the Tahsildar. After providing a reasonable opportunity to the petitioner and the current pattadhars, a speaking order shall be issued within three months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is also closed.
