Respondents PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus calling for the records relating to the impugned order passed by the 2nd respondent vide his proceedings in TR 2022/0103/15/307489TR dated 12.10.2022 for the present and quash the same as illegal and consequently direct the 2nd respondent to restore the patta regarding S.F.No. 3/4A1 and S.F.No. 3/4B2, situated at Kattuputhur East Village, Thottiyam Taluk, Trichy District to restore the old Patta No. 917.

A patta transfer order dated 12.10.2022 is assailed in this writ petition on the ground that such order was issued without notice to the petitioner.

2. Learned Special Government Pleader accepts notice for respondents 1 to 3. By referring to the communication dated 08.08.2025 2/5

from the Tahsildar to the Executive Officer of Kattuputhur Panchayat, learned Special Government Pleader submits that the petitioner has filed the present writ petition in order to prevent proceedings to remove encroachments made by the petitioner.

3. On perusal of order dated 12.10.2022, it appears that the petitioner was shown as a joint pattadhar in respect of Survey No.3/4B2 both prior to the patta transfer and after the patta transfer. Therefore, the petitioner cannot have any grievance against this order. If the petitioner asserts that she is the sole owner of land in Survey No.3/4B2, separate proceedings in that regard should be initiated. This order shall not stand in the way of the petitioner in filing an appeal.

4. With these observations, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 25.11.2025 NCC : Yes/No Internet : Yes/No Index : Yes/No PKN 3/5
