PRAYER: Writ Petitions filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents to disburse the pension vide PPO No.MDMU000575174 to the petitioner the employees pension scheme administered by the employees provident organisation towards the petitioner's father Kannan death, on the basis of the petitioner's representation dated 14.02.2023. ORDER
The petitioner's father, by name, Kannan was as a loadman. He had enrolled himself under the employees' pension scheme implemented by the EPF Authority and he was paying the contribution towards it. He died in a road accident on 06.01.2008 while in service. After his death, the petitioner was receiving pension from the 2nd respondent. However, the pension under the employees' pension scheme was all of a sudden stopped by the second respondent/EPF Authority. Therefore, the petitioner has submitted a representation dated 14.02.2023 to the 2nd respondent, seeking to disburse him the pension under the said scheme. The second respondent, by his proceedings dated 26.05.2023, directed the petitioner to submit the digital life certificate, bank pass book and pension payment order.
The petitioner has also produced all those documents as required by the 2nd respondent. However, the 2nd respondent / EPF Authority has not disbursed the pension amount. Therefore, the petitioner has filed this writ petition seeking a writ of mandamus to the respondents to disburse the amount to the petitioner under the Employees' Pension Scheme by considering his representation dated 14.02.2023.

Mrs.T.Saroja, learned Central Government Standing Counsel, takes notice for the 1st respondent and submits that on production of life certificate, the petitioner is entitled to get benefits and the same has also been intimated, by a letter dated 26.05.2023. 3.Mr.Karthick, learned counsel appearing for the 2nd respondent submits that the petitioner claims that his mother had married another person and in such event he is also entitled for the share of the pension. However only on production of the proof of her mothers re-marriage and other related details the petitioner's claim can be considered.
4. The learned counsel appearing for the petitioner submits that the petitioner has already submitted the relevant documents as required by the respondents. Even then, the 2nd respondent has not considered the claim of the petitioner.

6.It appears that the petitioner has already produced the life certificate. The petitioner claims that other details of the petitioner have already been produced by him. However, the petitioner shall produce the re-marriage details of his mother, if not already furnished, to the 2nd respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt such details, the 2nd respondent is directed to consider the materials if any produced by the petitioner and to pass suitable orders, within a period of four weeks therefrom, on the petitioner's representation by sanctioning eligible pension to the petitioner.
