ORDER

This writ petition has been filed for a writ of Certiorarified Mandamus calling for the records pertaining to the orders passed by the second respondent in his proceedings in O.Mu.No.3007/A2/2025 dated 28.10.2025 and quash the same and direct the respondents to grant prior permission to fill up the post of Watchman in the petitioner school. 2.The proposal sent by the petitioner School for appointment of watchman had been returned to find out whether any appeal had been filed against the order passed by this Court in W.P(MD)No.11994 of 2025 and also to obtain a legal opinion from the Court. 3.The order passed in W.P(MD)No.11994 of 2024 relates to the Society of which the petitioner School is an Educational Agency. The dispute between the Society cannot be put against the School, as the School is being managed by the School Committee approved by the respondents.

4. It is also made clear that this Court does not give any opinion. The reasons attributed in the order impugned are very innocuous. Accordingly, the impugned order is set aside and the matter is remitted back to the first respondent to consider the petitioner's proposal on merits and in accordance with law without being influenced by the dispute in the Society. Such exercise shall be completed by the first respondent within a period of four weeks from the date of receipt of a copy of this order.

5. The writ petition stands allowed. There shall be no order as to costs.
