ORDER

It is seen that the petitioner is a bonafide purchaser. However, there are settlement agreements between the accused persons and the defacto complainant which is applicable to the petitioner also. Based on the settlement agreement, this Court has granted anticipatory bail to the co-accused persons, vide common order, dated 05-12-2025, passed in CRL OP(MD)NOs. 18622, 18624, 18642 and 20879 of 2025.

2.Taking into consideration of the settlement agreement and since the petitioner has complied with the conditions imposed in the interim anticipatory bail regularly, the interim anticipatory bail already granted is made absolute and this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 3.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on conditions that:

[a]the petitioner shall report before the respondent police as and when required. [b]the petitioner shall not tamper with the evidence or witness either during investigation or trial.

[c]the petitioner shall not abscond either during investigation or trial. [d]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [e]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
