ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent dated 23.10.2025, wherein the petitioner was called upon to provide a suitable explanation regarding the pendency of the criminal case.

The learned counsel for the second respondent brought to the notice of this Court that the petitioner is implicated in Crime No.92 of 2021 on the file of the Keelavalavu Police Station, Madurai District. The charge sheet was laid by the second respondent police before the learned Judicial Magistrate, Melur and it was committed to the Special Court for Mines and Minerals. However, Special Court for Mines and Minerals has passed an order on 25.06.2024, to the effect that the offence under Section 21(4) of the Mines and Minerals (Development and Regulation) Act, 1957 had not been made out and therefore, the alleged offence is triable under Section 379 of IPC by the learned Judicial Magistrate, 2/5

Melur and on such finding, the committal order of the learned Judicial Magistrate, Melur, was set aside and it was remanded back to the concerned Judicial Magistrate Court to be tried by the said learned Judicial Magistrate.

3. Considering the aforesaid observations, the petitioner is directed to approach the learned Judicial Magistrate, Melur, seeking permission to go abroad. If such an application is filed by the petitioner, the learned Judicial Magistrate, Melur, shall dispose of the same within a period of four weeks from the date of filing. Based upon the order to be passed by the learned Judicial Magistrate, the first respondent is directed to proceed in accordance with law.

4. With the above directions, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed. 05.01.2026 tta 3/5
