Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to permit the petitioner to fully withdraw his money of the payment of his retirement benefits amount Rs. 5,12,810/- from his account vide S.B.A/c.No. 71591010012640 being maintained with the 4th respondent at a time instead of installment withdrawals with an accrued interest and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice. ORDER
This writ petition is filed seeking direction to the respondents to permit the petitioner to fully withdraw his money of the payment of his retirement benefits amount Rs. 5,12,810/- from his account vide S.B.A/c.No. 71591010012640 being maintained with the 4th respondent at a time instead of installment withdrawals with an accrued interest.
2. Considering the fact that the petitioner's terminal benefits have also been deposited into his account, there can be no impediment to the withdrawal of the said amount lying to his credit. 2/5

The learned Government Advocate would submit that the audit of the 3rd respondent Society is still pending, and that only after the audit is completed and any objections are received can the matter be finalized; otherwise, it would be difficult to recover the amount from the petitioner. Hence, she submitted that no such mandamus be granted.

This Court is of the view that if any objection is raised in the audit with regard to the petitioner's amount, it is for the respondents to recover the same in the manner known to law, as provided under the Tamil Nadu Co-operative Societies Act, 1983. Having sanctioned the terminal benefits and credited them to the petitioner's account, the respondents cannot deny the petitioner to withdraw the amount already standing in his name.
5. In view of the same, there shall be a direction to the respondents to permit the petitioner to withdraw the amount standing in his Saving Bank Account.

6. This writ petition is disposed of with the above directions. No costs.
