By relying on the 'A' Register in respect of survey Nos.212/7 and 212/10, the petitioner asserts that his father, Oorkavalan, was the owner of the property and that a joint patta has been issued in the name of the fourth respondent and the petitioner. After submitting an appeal before the Revenue Divisional Officer in this regard, the present Writ Petition has been filed seeking the early disposal thereof.

2. Learned Special Government Pleader accepts notice for respondents 1 to 3. He submits that the patta transfer was effected after taking note of the sale deed under which the joint pattadar purchased a portion of the property. Therefore, he submits that the petitioner has to seek relief before the jurisdictional civil court and not before the revenue authorities. Without prejudice, he submits that the second respondent would consider and dispose of the appeal on merits. 2/4

Considering the above submissions, without expressing any opinion on the merits, this Writ Petition is disposed of by directing the second respondent to consider and dispose of the petitioner's appeal on merits within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and the fourth respondent.

4. Since the merits have not been examined and in view of the direction to the Revenue Divisional Officer to provide a reasonable opportunity to the fourth respondent, this Writ Petition is being disposed of without notice to the fourth respondent.
