Respondent/Accused Prayer :- This Petition to be filed U/s.138 NI Act and 142 of Negotiable Instruments Act against the Judgment of Acqittal passed by the Judicial Magistrate No.II(FTC), Nagercoil in CC No.39 of 2012 dated 20.09.2012 for the offence under section 138 of Negotiable Instruments Act.

ORDER:- This Appeal coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.Vashik Ali, Advocate for the Appellant and of Mr.G.Thalaimutharasu, Advocate For C.Chrishtopher,Advocate for the respondent this Court made the following order:

When this matter is called for question of sentence pursuant to the order of this Court dated 05.04.2023, the respondent is present in person before this Court and has stated that she borrowed only Rs.10,500/- and she is ready to return the said amount, if this Court proposes to order for any sentence. She is ready to settle the amount only before the temple after getting promise from the appellant, since she never borrowed such huge amount from the appellant as claimed by her.

2. In view of the above, this Court convicts and sentences the respondent to be present till the rising of the Court and awards a compensation of Rs.10,500/- (Rupees Ten Thousand and Five Hundred only) payable by the respondent to the appellant directly on or before 08.05.2023, in default, she shall undergo two weeks of simple imprisonment.
