O R D E R

The present writ petition has been filed seeking a Mandamus as against the first respondent to re-issue a passport to the petitioner based upon his application.

2. The learned Government Advocate (Criminal Side) appearing for the second respondent brought to the notice of this Court that the petitioner has been implicated in a case in Crime No.376 of 2021 for the offence under Sections 20(b) (ii)(B), 8 (c) NDPS Act, on the file of the second respondent and a charge sheet has been laid and the same has been taken on file in C.C.No.99 of 2022 on the file of the learned Additional District Judge for E.C and NDPS Act cases, Pudukkottai District.

3. It is also brought to the notice of this Court that the petitioner has been implicated in another case in Crime No.265 of 2024 for the offence under Section 25(1B) (b) ARMS Act, on the file of the second respondent, in which, a charge sheet has been laid and so far not taken on file. 2/4

4. Considering the serious allegations as against the petitioner, a Mandamus cannot be issued as against the first respondent for issuance of passport to the petitioner till the disposal of criminal cases.

5. In view of the above, this Writ Petition stands dismissed. There shall be no order as to costs.
