Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records relating to the proceedings of the third respondent vide Property tax assessment No.150/036/900127 dated 06.10.2025 for Door No.613 B in Ward No.14, Cap Road, Kottar, Nagercoil and quashing the same as illegal and consequently to direct the third respondent to fix the rental value in accordance with the order of this Court dated 23.01.2024 in W.P.(MD) No.13281 of 2020 and the order of the second respondent in Appeal No.9/05/A3 dated 29.05.2006 vide Resolution No.1 of 2006 within the period that may be stipulated by this Court. Heard both sides.

2.It is seen that the impugned order has been passed by the Commissioner, Nagercoil, Municipal Corporation, without taking into account the direction given by the Taxation Appeal Committee. On this sole ground, the impugned order is quashed. The matter is remitted to 2/4

the file of the third respondent to pass an order afresh on merits and in accordance with law.
