Respondents PRAYER :- Civil Revision Petition filed under Article 227 of The Constitution of India to follow the provisions of Order 7 Rule 10 and Rule 10A of the Civil Procedure Code whereby the date of hearing for appearance of the parties had been fixed as 15/04/2024 by the District Munsif cum Judicial Magistrate Court, Peraiyur in O.S.No. 89 of 2016 and consequentially directing the Sixth Additional District and Sessions Court, Madurai to proceed with the trial of the suit from the stage at which the suit originally stood on 12/03/2024 and to dispose of the suit in O.S. No. 224 of 2024 within a time limit that may be stipulated by this Court.

ORDER
This Civil Revision Petition filed to direct the learned VIth Additional District and Sessions Judge, Madurai, to expedite the trial in O.S.No.224 of 2024 within a time frame to be fixed by this Court.

Pursuant to the order of this Court dated 02.01.2025, the trial Court has sent a report to the Registrar (Judicial) vide proceedings in D.No.7, dated 02.01.2026, furnishing the year wise breakup with regard to the pendency of the cases. For the year 2024, when the suit now sought to be expedited was filed, there were 135 cases pending and from the year 2025 to till date, 167 cases are pending.

The learned counsel for the respondent pointed out that the suit was originally filed in the 2016 in O.S.No.89 of 2016 on the file of the District Munsif cum Judicial Magistrate Court, Peraiyur and the same was transferred to the file of the Sixth Additional District and Sessions Judge, Madurai and renumbered as O.S.No.224 of 2024. He further submitted that there are connected suit pending between the parties for the very same claim.

4.Considering the fact that the suit has been pending since 2016 and taking note of the huge pendency of the cases before the trial Court, the learned Sixth Additional District and Sessions Judge, Madurai, is directed to club the connected suit together with the suit in O.S.No.224 of 2024 and conclude the trial of the cases within a period of one year from the date of receipt of a copy of this order.
5. With the above direction, this Civil Revision petition is disposed of. No costs.
