JUDGMENT
(Judgment of the Court was made by DR.ANITA SUMANTH, J.) The Writ Appeal has been filed by R3 in the Writ Petition. 2.The prayer of the writ petitioner, arrayed as R1, was for a direction to the respondents to consider his application for a new service connection in Door No.3/30/1, Thirunadampatti Village, Thirumayam Taluk, Pudukkottai District.
3.R1 had applied for a service connection on 26.06.2025 and had not been given the benefit of the same. The writ Court notes that a civil suit had been pending with regard to the property in question in O.S.No.15 of 2025 on the file of the Judicial Magistrate cum Munsif Court, Thirumayam.
4.Finding that the service connection had been kept pending without any reasons being assigned for the same and also that there was no prohibitory order restraining the issuance of service connection in the 2/4
pending suit, the learned Judge directed the authorities to grant service connection, subject to the result of the suit. We find absolutely no infirmity in the said order. The apprehension of the appellant, that the grant of service connection would somehow affect the outcome of the suit is unfounded. Anticipating such possibility, the writ Court has observed that the direction to grant service connection would not result in conferring any opinion on the title or otherwise of the property. We reiterate this caveat.
5.This Writ Appeal is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
