ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 7, 8, 11(3) r/w Section 12 of POCSO Act, 2012, in Crime No.38 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the victim girl, aged 17 years, is studying 12th standard. On 24.10.2025, while returning home from school around 6:00 PM, near the Arumuganeri market, the petitioner caught the girl's hand and pulled her. At that time, the accused showed her an obscene image on his mobile phone. The girl got scared and ran to her home. Hence, a case has been registered against the petitioner.

3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.

1. The learned Additional Public Prosecutor strongly opposed to grant anticipatory bail to the petitioner.

5. On perusing the 164 statement, it is seen that the 164 statement completely supports the case of prosecution. The victim girl has clearly stated the occurrence.

6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

7. Accordingly, this Criminal Original Petition is dismissed. 26.11.2025 TMG TO 1.The Inspector of Police, AWPS Tiruchendur Police Station, Thoothukudi District.
