Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents 1 and 2 to conduct a survey and fix the four petitioner boundary line and to lay survey stone to petitioner property measuring an extend of 2 acres 32 cents in Survey No. 47/3 Valanthai Village, Abiramam Sub-division, Ramanathapuram District based on petitioner title document dated 11.10.2007 in document no. 1032 of 2007 on the file of Abiramam SRO and patta in patta no. 8992 issued by the second respondent within a time frame fixed by this Court. 1/4

O R D E R

By relying on a sale deed dated 11.10.2007 and the patta No. 8992, the petitioner had applied online for a survey of 94 ares in survey No.47/3. The present Writ Petition relates thereto.

2. Learned counsel for the petitioner submits that there is no title dispute and that the respondents 3 and 4 are the owners of the adjacent land, as evidenced by the sale deeds dated 28.03.2016, 10.05.2016 and 28.04.2013, respectively.

3. Learned Special Government Pleader accepts notice for respondents 1 and 2. He submits that the Tahsildar would consider the petitioner's request for a survey after issuing notice to respondents 3 and 4 and any other owners of relevant adjacent lands. 2/4

4. In view of the above submissions of learned Special Government Pleader, it is unnecessary to issue notice to the third and fourth respondents in this Writ Petition. Instead, this Writ Petition is disposed of by directing the Tahsildar to conduct an inquiry in relation to the petitioner's request for a survey after issuing notice to the third and fourth respondents herein and any other relevant adjacent landowners. Objections, if any, from the said persons shall be taken into consideration before a decision is taken. For the avoidance of doubt, it is clarified that boundary disputes may be decided by the Tahsildar, but the party should be relegated to the jurisdictional civil court if there is a credible title dispute.
