This Criminal Original Petition is filed to quash the case in Crl.A.No.76 of 2023 on the file of the 2nd Additional District and Sessions Court, Thoothukudi.

2. The petitioner, who is the applicant before the learned Magistrate in the domestic violence proceedings and succeeded partly in the said proceedings, has come up with this strange prayer. The respondent herein, aggrieved by certain directions issued by the learned Magistrate in D.V.A.No. 20 of 2017, has filed an appeal before the Sessions Court in Crl.A.No.76 of 2023 under Section 29 of the Domestic Violence Act. It is not known as to how an appeal can be quashed. It is also not the case of the petitioner that the respondent has no right to file an appeal. Hence, this Court cannot entertain this petition.

3. Accordingly, the Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 27.11.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No Lm To The 2nd Additional District and Sessions Court, Thoothukudi.
