Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to take expeditious legal action, based on the land measurement report dated 04.09.2025 to remove the encroachment made by the third respondent in the residential plot bearing Town Survey No. 24/1 (Old Survey No.30/112 part) in Ward-C, Block-25, Thirumangalam Town, based on the report dated 04.09.2025 within a time frame to be stipulated by this Court.

ORDER

(Order of the Court was made by DR.ANITA SUMANTH, J.) Heard Mr.A.Ananda Raj, learned counsel for the petitioner and Mr.J.Ashok, learned Additional Government Pleader for R1 and R2. No notice, in light of the order passed below, is issued to R3. 2.The prayer of the petitioner is for a mandamus directing the Commissioner of Thirumangalam Municipality, Madurai District to take action as against the encroachment said to have been made by R3 in the residential plot in Town Survey No.24/1 (Old Survey No.30/112 part) in Ward-C, Block-25, Thirumangalam Town.

3.The problem is that it is claimed by the petitioner that the aforesaid property is the private property of the petitioner, in which case, the proper recourse left to the petitioner would be to approach the civil Court. The petitioner also relies upon report dated 04.09.2025, which he says, is in his favour. Let the petitioner produce the document before the civil Court. In any event, mandamus is not liable to be issued to the 2/4

petitioner.
