Prayer : Civil Miscellaneous Petition is filed to condone the delay of 326 days from filing this present Appeal against the Decree and Judgement passed in O.S.No.42 of 2018 on 22.08.2024 by the Additional District Court at Sivagangai.

ORDER

This Civil Miscellaneous Petition has been filed to condone the delay of 326 days in filing the Appeal Suit in A.S.(MD)SR No.100890 of 2025 before this Court.

2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.

3. The learned counsel for respondent Nos.1 to 3 submitted that this petition be allowed with costs imposed on the petitioners.

4. The name of the 4th respondent has been printed in the cause list. 2/4

5. Being satisfied with the reasons stated in the affidavit, and also considering the duration of delay, this Court is inclined to allow this petition on payment of costs. Accordingly, this Civil Miscellaneous Petition is allowed on payment of costs of Rs.1,000/- (Rupees One Thousand only) by the petitioner to respondent Nos.1 to 3, within a period of ten days from the date of receipt of a copy of this order, failing which this petition shall stand automatically dismissed without any further reference to this Court.
