Seeking to call for the records relating to the FIR in Crime No. 334 of 2025 on the file of the 1st respondent police, this Criminal 1/5

Original Petition is filed.

The learned counsel for the petitioner submitted that the petitioner is an Allopathy doctor, and she has been separated from her husband, who is the de facto complainant herein, for the past few months. Already a petition for restitution of conjugal rights has been filed by her before the learned Family Court, Theni, and the same is pending.

3. In the meanwhile, for the purpose of getting his no objection for her minor child, she had gone to her husband's shared matrimonial home. A false complaint has been lodged by the de facto complainant, on the basis of which the crime No.334 of 2025 for the offences under sections 329(3), 296(b), 324(4), and 351(2) of BNS came to be registered as against the petitioner. A CCTV is very well available in the premises of the shared matrimonial home. If at all the 1st respondent had seized the same and had properly investigated, the factum as to the innocence of the petitioner would have been revealed. Having not done so, the false case has been registered as against the petitioner.

4. In view of the said submission made by the learned counsel for the petitioner on 03.12.2025, this Court directed the first respondent police to produce the CCTV footage showing the petitioner indulging in breaking the calling bell as well as the window of the second respondent's house.

Today when the matter came up for hearing, the learned Government Advocate (Crl. side), Mr.M.Sakthi Kumar, produced before me the CCTV footage in this regard, and a careful perusal of the said footage would reveal that the petitioner had only pressed the calling bell and had knocked on the windows, and since there was no response from anyone from inside the shared matrimonial home, she had left the spot.

6. Fully convinced that the petitioner is an innocent woman, the FIR in Crime No. 334 of 2025 is hereby quashed.

7. Accordingly, this Criminal Original Petition is allowed. Consequently, connected miscellaneous petition is closed. 16.12.2025 Index : Yes/ No NCC : Yes / No 3/5
