This writ petition has been filed to quash the impugned order passed by the 3rd Respondent in Na.Ka.No.88/2013 dated 07.08.2025 and consequential direction to the respondents to release the arrear amount Rs.4,39,243/- (Four Lakhs Thirty Nine Thousand Two Hundred and Forty Three Rupees only) together with the interest of 6% to the Petitioner within a stipulated time.

It is the grievance of the petitioner that audit objection making him liable for the periods 2017-2018 and 2018-2019 is totally incorrect inasmuch as this contract has been terminated even as early as in the year 2016. It is his contention that he would be liable to the audit objection only with reference to the period 2015-2016, which is a sum of Rs.43,000/-, even according to the petitioner after deducting a sum of Rs.43,000/-, a sum of Rs.4,39,243/- is due to the petitioner. It is his further contention that the impugned order has been passed without even affording of personal hearing to the petitioner.

Without dwelling much upon the merits of the matter, taking note of the fact that the impugned order has been passed without notice to the petitioner, this Writ Petition is allowed and the impugned order passed by the 3rd Respondent in Na.Ka.No.88/2013 dated 07.08.2025 is hereby set aside and the matter is remitted back to the third respondent for fresh consideration and pass order after affording an opportunity of personal hearing to the petitioner. Such exercise shall be done within a period of one month from the date of receipt of a copy of this order. No costs.
