O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus forbearing the respondents herein from conducting any survey or effecting patta mutation in respect of the property in Survey No.147/3, situated at South Kuruvikulam Village, Thiruvengadam Taluk, Tenkasi District.

2. The third respondent, Vethammal, filed a Writ Petition in W.P. (MD) No.6594 of 2025 before this Court seeking a direction to survey and fix the boundaries of the land in Survey No.147/3, covered by Patta No.

75. Pursuant to the direction issued by this Court in the said Writ Petition, vide order dated 12.03.2025, notices were issued to the petitioner for conducting the survey.

3. The present Writ Petition has been filed questioning the survey proceedings pursuant to the notices issued to the petitioner by the Tahsildar, the first respondent herein.

4. Once an order is passed by this Court to conduct a survey, the officials are bound by such order and are required to conduct the survey. In the process of conducting the survey pursuant to the order of this Court, notices were issued. Several grounds have been raised by the petitioner in this Writ Petition making certain claims and there are counter-claims as well. Once a representation/application is made, it is for the authorities to dispose of the said representation/application. When the Court made the above observations, the learned Government Advocate appearing for the first and second respondents submitted that in obedience to the order of this Court, the survey was conducted.

5. In view of the above, cause of action does not arise in the present Writ Petition. However, all remedies are left open to the petitioner. Accordingly, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
