Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Respondent 1 to 3 to survey the petitioner property and demarcate the four boundaries in Survey Nos.29/9, 29/10 situated at Sevallur, Manaparai Taluk, Trichirapalli District with aid of 4th respondent consequently direct the respondent 1 to 3 to serve the 1/5

ORDER

By relying on gift deed dated 12.09.2018 and the extracts from the Town Survey Land Register, the petitioner had applied for a survey of the land in T.S.No.29/9 of an extent of 69 square meters.

2. Learned Government Advocate accepts notice for respondents 1 to 3 and learned Government(crl.side) accepts notice for the 4th respondent.

3. On instructions, learned counsel for the petitioner submits that there is no rival title claim and that the 5th and 6th respondents are owners of adjacent lands.

4. The petitioner has submitted Town Survey Land Register extract reflecting the petitioner's name in respect of T.S.Nos.29/9 and 29/10. As such, a case is made out to consider the petitioner's request. Before undertaking any survey, notice should be issued to owners of relevant adjacent lands, including the 5th and 6th respondents. Objections, if any, from the said persons shall be taken into account. For the avoidance of doubt, it is clarified that boundary disputes may be decided by the Tahsildar. However, if there is a credible title dispute, the party should be relegated to the jurisdictional civil court.

5. In view of these directions, this writ petition is disposed of without notice to the private respondents by further directing that the entire process shall be concluded within three months from the date of receipt of a copy of this order. No costs.
