judicial custody on 04.10.2025 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) and 22(C) of the NDPS Act, in Crime No. 303 of 2025 on the file of the respondent, seeks bail.

The case of the prosecution is that on 04.10.2025 at about 14.30 hours, on secret information, the respondent police went to the backside of Naganathar Temple in Kumbakonathan Street, Thanjavur, and intercepted the a motorcycle bearing Reg.No.TN-68-AJ-5516 and on searching, the accused was found in illegal possession of 2 kg of ganja and 180 gram of Diazepam powder and on further search made in the house of the petitioner, they also found 2.5 kg of ganja and 370 grams of Diazepam powder. Hence the case.

The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been arrested and remanded to judicial custody on 04.10.2025. Therefore, prayed to grant bail for the petitioner.

The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner was found in illegal possession of 2 kg of ganja and 180 gram of Diazepam powder and on further search made in the house of the petitioner, the respondent also found 2.5 kg of ganja and 370 grams of Diazepam powder and the investigation is still pending and the petitioner has previous cases. Hence, he strongly opposed to grant bail to the petitioner. 5 This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side, nature of offence, and the quantity involved in this case is a commercial quantity and the petitioner also having previous cases and considering the gravity of the offence, I am declined to grant bail to the petitioner at this stage.

7.Accordingly, this Criminal Original Petition stands dismissed. 3/5
