ORDER
The above writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 2nd respondent to issue tender schedule to the petitioner relating to the tender notification in Tender Notice 7/56M/DB/JDO-1/F-2/2025-26 dated 04.11.2025 and permit the petitioner to participate in the tender based on the representation of the petitioner dated 20.11.2025 and pass such further of other orders as this Honorable Court may deem fit and proper in the circumstances of the case and thus render justice ."
2. Mr.D.Sasi Kumar, learned Additional Government Pleader takes notice on behalf of the respondents 1 and 2.
3. By consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself. 2/6

It is seen that the respondents have refused to issue the tender schedule to the petitioner on the ground that the payment has been made on a different account namely Cost of Tender Schedule Account Code: 0059-80-800-AC-22705 instead of upper Cost of Tender Schedule Account Code:0059-80-800-AC-23309 and that the requisite documents had not been produced. It is rather strange that the respondents who have received the petitioner's email with the payment on 20.11.2025 at 12.48 has not brought to its notice that the payment has been made under a different head. Had this statement being brought of the notice to the petitioner, he could have rectified his mistake immediately and it is only now that this order has been passed and the order appears to have been passed even immediately rejecting the request. The entire action of the respondents smack of malafides and appears to be premeditated.
5. Therefore, the writ petition is disposed of with a direction to the petitioner to make necessary payment along with the document before 04.45 to the respondents. M.Selvakumaran, Senior Drafting Officer, Office of the Executive Engineer, who is present today, is directed to issue tender schedule to the petitioner. Since the orders are being passed in the 3/6
presence of the officials concerned he shall not await the signed orders of this Court.
