For Respondent : Mr.E.Antony Sahaya Prabahar Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- C-6AB To pass an order directing the petitioner to be released on bail in the event of his arrest in connection with P.R.C.No.16 of 2024 on the file of the Learned Judicial Magistrate, Pattukottai, Thanjavur District, in Cr.No.239 of 2017 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 147, 148, 324 and 302 of IPC, in Crime No.239 of 2017, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that when the petitioner was stand near a two wheeler workshop, the petitioner and other accused persons came via auto and brutally attacked one Mydeen due to which he sustained injury. The defacto complainant admitted him in hospital and subsequently, he succumbed to death in hospital. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offences as alleged by the prosecution, and he has been falsely implicated in this case. He further submitted that the petitioner 2/6

is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail for the petitioner.

4. The learned Additional Public Prosecutor submitted that it is a case of jumped out bail. Therefore, this Court cannot grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that it is a case of jumped out bail, the petitioner is directed to surrender before the trial Court and file a recall petition. On such filing of recall petition, the learned Magistrate is directed to consider the recall petition on the same day.

6. With the above direction, this Criminal Original Petition is disposed of.
