O R D E R

This Writ Petition is filed to direct the second respondent to conclude the enquiry initiated vide a notice dated 07.10.2025 and take necessary action in accordance with law within time frame by this Court.

2. The matter is all about the matrimonial dispute between the petitioner and her in-laws, including her husband, which involves 200 sovereigns of gold jewellery. The marriage between the petitioner and her husband was held on 03.11.2022.

3. On instructions, the learned Government Advocate (Crl.Side), Mr.A.S.Abul Kalaam Azad, submitted that it is only the petitioner who is not cooperating with the enquiry conducted by the second respondent police. Despite issuance of summons on 10.10.2025, the husband appeared for enquiry and the petitioner did not cooperate with the enquiry. Page No. 2 of 5

However, this Court is of the considered view that while dealing with matrimonial disputes that too where a huge quantity of gold is involved, the Police officials should be sensible in dealing with the matter and should be patient enough to sensitize the victim to understand the importance of participating in the in-house enquiry conducted by the Station House Officer.

In view of the same, the second respondent is directed to issue a summons afresh on or before 10.12.2025 to both the parties concerned, including the petitioner, her husband and in-laws and take positive and credible action in recovering the gold involved in the matrimonial dispute positively within a period of two weeks from the date of summons and therefore, conclude the enquiry within a period of 10 days therefrom.
