ORDER

This Criminal Original Petition is filed under Section 482 CrPC / Section 528 BNSS, seeking to quash the Crime No.9 of 2025 on the file of the 1st respondent.

2.The gist of the allegations in the FIR is that the accused persons received a sum of Rs.20,00,000/- from the defacto complainant in order to secure a government job. Thereafter, they neither secured the job nor repaid the amount. Pursuant to the complaint given by the defacto complainant / second respondent, a case in Crime No.9 of 2025 was registered on the file of the first respondent against the petitioners for the offences under Sections 420 & 120(B) of IPC on 21.04.2025. Seeking quashment of the FIR, this Criminal Original Petition is filed.

3. The learned counsel for the petitioners submitted that the petitioners are the accused persons in Crime No.9 of 2025. However, after registration of First Information Report, at the time of moving anticipatory bail petition before this Court, on 02.12.2025, the petitioners and the defacto complainant have arrived at compromise and agreed to settle the dispute between themselves. The second petitioner settled the entire amount payable to the defacto complainant 2/6

and the same was also received by the defacto complainant and the said compromise and the transaction was duly recorded by this Court in the order dated 04.12.2025 in Crl.OP(MD)Nos.13235 and 18351 of 2020 and the relevant portion of the said order is as follows:- "5.This Court has already granted interim anticipatory bail to the petitioners and referred the matter to Mediation and Conciliation Centre. Today, it is reported that the parties have settled the issue in the mediation and they have entered into a settlement agreement and the settlement agreement is signed by the parties as well as their learned Counsels. The terms of the settlement agreement are as under:

"A. The petitioners in CRL OP(MD)No.13235 of 2025 & Crl.O.P(MD) No. 18351/2025 are Accused in Crime No. 9/2025 on the file of the Inspector of Police District Crime Branch (DCB Police Station), Ramanathapuram District.

B. Now a compromise has been entered between the parties and accordingly, Accused No.2 Thiru. Bharathi has agreed to return the money received by him from the Defacto Complainant. C. On the basis of such agreement, today (02.12.2025) Accused No.2 has settled the entire amount payable to the Defacto Complainant and the same is also received by the Defacto Complainant.

D. On receipt of such amount, the Defacto Complainant agrees to cooperate for quashing of FIR filed in Crime No.9/2025. She has also agreed to give no objection for allowing the quash petition filed in Crl.O.P(MD) No. 21604/2025 pending on the file of 3/6

the Hon'ble Madurai Bench of Madras High Court. E. The Defacto Complainant assures that she has no further claim either against Accused No. 2 or other two Accused namely Accused No. 1 and 3 and she further assures that she will not initiate any further action against them."

4. Only on the basis of the said settlement, this Court granted anticipatory bail to all the petitioners with certain conditions. All the conditions are duly complied with and hence he prayed to allow this petition.

The learned Government Advocate (Crl.Side) appearing for the first respondent also fairly conceded that this Court at the time of consideration of anticipatory bail applications, which was filed by the petitioners herein, had recorded the compromise arrived at between the parties and the total amount involved in the said dispute.

6. Heard both sides and perused the materials available on record.

7. The said compromise has been arrived at between the parties before the Mediation Center attached to this Madurai Bench of Madras High Court. In view of the compromise arrived at between the parties, the possibility of 4/6

conviction is rendered remote and bleak. Continuation of the criminal proceedings would therefore serve no useful purpose and would amount to an abuse of the process of Court.

8. Accordingly, the Criminal Original Petition is allowed and First Information Report in Crime No.9 of 2025 dated 21.09.2025 on the file of the first respondent is hereby quashed.
