PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus or any other Writ or Order or direction in the nature of the Writ to call for the records pertaining to the impugned order passed by the 3rd in Respondent vide proceedings Ka.No. 10167/E8/Pa.A/ TNSTC/ Thili/2025, dated 04-11-2025, and quash the same as illegal, and consequently direct the Respondents to re-fix the pay of the Petitioner by adopting the 2.57 multiplier/matrix on par with the 7th Pay Commission revision from the date of promotion and revise all other retirement benefits, including pension, in the light of the order passed in W.P. (MD). No.3609 of 2020 dated 20.06.2023, which was confirmed by the Division Bench in WA(MD)No.1099 of 2024 dated 04.07.2024, within a stipulated time that may be fixed by this Court. ORDER

This Court had dealt with a similar issue and passed orders in a batch of writ petitions in W.P.(MD) Nos.28170 of 2025 dated 26.11.2025, wherein after hearing the respective parties, this Court had held that the employees who had migrated to the Managerial cadre after 01.01.2016 and who were not benefited with the 13th wages settlement of the year 2016 which came into effect from 01.09.2017 are entitled to 2.57 multiplier / matrix for the reasons indicated therein. The petitioner herein who had also migrated on 13.03.2017, in the managerial cadre and has not been benefited with the 2016 wage settlement as the same has been implemented only with effect from 01.09.2017.

In such view of the matter, the petitioner is also entitled for the application of 2.57 multiplier/ matrix from the date of their promotion by taking into account the 7th pay commission and all consequential monetary benefits with subsequent increments and also revise their terminal benefits accordingly.

In view of the same, this Writ Petition is allowed and there shall be a direction to the respondents to revise the pay of the petitioner by adopting 2.57 multiplier / matrix on par with the 7th pay commission from the date of promotion and revise all other retirement benefits including pension. Such exercise shall be carried out within a period of twelve (12) weeks from the date of receipt of a copy of this order. No costs.
