ORDER

This Writ Petition has been filed to direct the 1st and 2nd respondents to initiate legal action against the 3rd to 7th respondents based on the petitioner's representation dated 18.09.2025 within the time frame fixed by this Court.

2. This writ petition is disposed of at the admission stage, after dispensing with the notice on the private respondents.

3. Heard the learned counsel on either side, and have perused the materials available on record.

4. It is the case of the petitioner that the petitioner is engaged in the business of buying and selling offset printing machines. His eldest daughter was employed at a gift shop, namely Great Look Gift Shop, Sivakasi, owned and operated by the 3rd and 4th respondents. Through frequent visits to the said 2/5

shop, the petitioner and his wife became acquainted with the 3rd and 4th respondents, who, along with respondent Nos.5 to 7, represented that they were involved in real estate business and owned several acres of land along the Sattur - Virudhunagar four lane road. They claimed that the land would be divided into five cent plots and sold at profitable rates, promising significant returns within a short period.

Trusting their representations, on 20.12.2020, the petitioner's wife and a relative paid a sum of Rs.10,00,000/- in cash to respondent Nos.3 to 7 for the purchase of two plots, based on assurances that the land would be cleared, DTCP approval obtained, and registration completed. However, after receiving the money, the respondent Nos.3 to 7 delayed with excuses and eventually stopped communicating. Thereafter, the petitioner discovered that no land stood in the names of the said respondents and that they had similarly cheated several others. The said respondents subsequently absconded closing their shop and residence. Despite lodging complaints before the 2nd respondent police and submitting a detailed representation dated 18.09.2025 to the 1st and 2nd respondents, no action has been taken. Hence, the present petition.

6. Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Criminal 3/5

Side), on instructions, submitted that the matter has already been considered, an enquiry has been conducted, and the same has been concluded by advising the respective parties to approach the appropriate civil court for suitable remedy.

7. Recording the same, this Writ Petition is disposed of. However, in view of the petitioner's request, this court is inclined to give liberty to the petitioner to approach the appropriate Judicial Magistrate for seeking proper remedy.
